Like the Larry Summers affair, it reveals how the people who run the institution-side of things have lost all control of the faculty. They should have never let the faculty portray the individual universities as party to the suit, if only not to have the U appear to take the legal drubbing rather than a few vocal faculty (who clearly ain't so good at assessing their own case).
Thx for the link, I've actually read Polsby's take on this before. Looks like Zengerle is more or less the same position. It is crazy to me that FAIR invested its (the respective law schools actually) credibility in a case that was so obviously a long shot. Very interesting that the DoD would have signed an AALS statement that said "unlawfully discriminates."
